19.5.1 Preexisting Conditions

Florida law prohibits individual health insurance policies, other than disability income, from excluding coverage for a preexisting condition for longer than 24 months following the effective date of coverage for a condition that had manifested 24 months prior to coverage.

A Medicare supplement policy may not exclude benefits based on a preexisting condition if the individual has a continuous period of creditable coverage of at least six months as of the date of application for coverage. [Sec. 627.6741; FAC Rule 69O-156.009]
